Terms and Conditions

Welcome to Tromsø Explorer! These Terms and Conditions (“Terms”) govern your access to and use of our website, TromsoExplorer.no, and the services we offer, including private tours, outdoor activities, and bookings (“Services”) provided by Tromsø Explorer (“we,” “us,” or “our”).

Tromsø Explorer is operated by LOGINS AS, a company registered in Norway with organization number 931072056. Our registered address is Hansmarkvegen 12, 9013, Tromsø. All services provided under these Terms are delivered by LOGINS AS.

By using our website or booking any of our services, you agree to be bound by these Terms.

1. Definitions

“Services”: Private tours, outdoor activities, and related offerings provided by Tromsø Explorer.

“Customer” or “you”: Any individual who books or participates in our services.

“Booking”: The process of reserving services through our website or other approved means.

2. Scope of Services

Tromsø Explorer offers private tours and outdoor experiences in the Tromsø area. Our activities include boat tours, car tours, hiking adventures, and Northern Lights chases. Full details regarding pricing, availability, duration, and inclusions are available on our website.

3. Booking and Payment

3.1 Booking Process

  • You must provide accurate and complete information when making a booking.
  • Bookings can only be made by individuals who are 18 years of age or older.
  • All bookings are subject to availability and confirmation from Tromsø Explorer.
  • By completing a booking, you confirm that you have read and accepted these Terms.
  • We strongly recommend that all customers hold personal travel insurance covering outdoor activities, medical emergencies, and cancellations.

3.2 Payment

  • Payment in full is required at the time of booking unless otherwise agreed in writing.
  • All payments are processed securely via our payment provider, Stripe, in accordance with Stripe’s terms and privacy policies.
  • All prices are listed and charged in Norwegian Kroner (NOK).
  • All prices include 25% Norwegian VAT (MVA).
  • Tromsø Explorer is not responsible for any differences caused by currency exchange rates or international bank fees applied during payment or refund processing.

3.3 Confirmation

Once payment is successful, you will receive a confirmation email with the tour details, schedule, meeting location, and other relevant information.

4. Cancellation and Refund Policy

4.1 Cancellations by the Customer

If you need to cancel your booking, the following cancellation terms apply:

  • More than 14 days before the tour date: You are entitled to a full refund, minus an administrative fee corresponding to payment processing costs (3.9% + NOK 2.00 for Norwegian and EU cards; 4.75% + NOK 2.00 for UK and international cards).
  • Between 7 and 14 days before the tour date: 50% of the total booking amount will be refunded.
  • Less than 7 days before the tour date: No refund will be issued.

The administrative fee reflects actual transaction charges incurred at the time of booking and is non-refundable.

Exception: If you are unable to participate due to unavoidable and extraordinary circumstances at the destination that significantly affect the performance of the tour (such as severe weather warnings, natural disasters, or government restrictions), you are entitled to a full refund without any administrative fee.

Please contact us as soon as possible if you need to cancel or reschedule.

4.2 Cancellations by Tromsø Explorer

We may cancel a tour due to circumstances such as:

  • Dangerous or extreme weather conditions
  • Safety concerns
  • Events beyond our control (see Section 8: Force Majeure)

In such cases, you will be offered:

  • A full refund processed within 14 days, or
  • The option to reschedule the tour at no extra charge

We strive to inform customers of cancellations as early as possible and will work with you to find a suitable alternative.

5. Customer Responsibilities

As a customer, you agree to the following:

  • Arrive at the designated meeting point on time. Late arrivals may result in loss of participation without eligibility for a refund.
  • Follow all safety instructions provided by Tromsø Explorer staff or guides throughout the activity.
  • Ensure that children under the age of 16 are accompanied by a responsible adult.
  • Participants aged 16–17 may join tours without an accompanying adult only if written parental or guardian consent is provided prior to the activity.
  • You are responsible for ensuring that you are physically fit to participate in the selected activity.
  • Acknowledge that outdoor activities inherently involve risks related to weather, sea conditions, and Arctic environments.
  • Do not arrive intoxicated or behave inappropriately. Tromsø Explorer reserves the right to refuse boarding or participation, or cancel the tour, without refund, if a customer is under the influence of alcohol or drugs, or engages in offensive, unsafe, or disruptive behavior. Such cases are considered a breach of contract by the customer and do not qualify for a refund.
  • Alcohol is strictly prohibited on all our tours.

6. Activity-Specific Terms

6.1 Fishing Tours and Boat Tours

  • Passengers must be at least 140 cm tall.
  • All passengers must wear a floating device (provided by Tromsø Explorer) and participate in a mandatory safety briefing before departure.
  • Tours on the sea can be physically demanding; customers must be in good health and prepared for the conditions.
  • Pets are not allowed on the tour.
  • The tour is not wheelchair accessible.

6.2 Aurora Chasing Tours and Sightseeing tours

  • The tour is not suitable for infants.
  • Pets are not allowed on the tour.
  • The tour is not accessible by wheelchair.
  • While we do everything possible to maximize your chances, we cannot guarantee that you will see the Northern Lights due to the unpredictability of weather and solar activity.

7. Liability

7.1 Tromsø Explorer’s Responsibility

Tromsø Explorer is responsible for ensuring that the services provided correspond to the descriptions and agreements made at the time of booking, in accordance with Norwegian law.

We are liable for direct damages or losses caused by proven negligence from Tromsø Explorer or its representatives.

Tromsø Explorer is not liable for minor deviations from the agreed service that do not significantly affect the overall delivery of the tour or activity.

Our liability is limited to direct economic losses and does not cover indirect or consequential damages, such as lost income, missed connections, or similar losses, to the extent permitted by Norwegian law.

7.2 Customer’s Responsibility

Participation in all activities is at your own risk.

  • You are responsible for following all safety instructions provided by Tromsø Explorer staff.
  • You are responsible for ensuring that you are appropriately dressed and equipped for the activity as described at the time of booking.
  • Customers must inform Tromsø Explorer of conditions, limitations, or other factors that could impact their safe participation.

Tromsø Explorer is not liable for losses, damages, or injuries resulting from:

  • Failure to follow safety instructions.
  • Participation under the influence of alcohol or drugs.
  • Health conditions or limitations.
  • Use of inappropriate clothing or equipment despite provided guidance.

7.3 Exclusions of Liability

Tromsø Explorer is not liable for:

  • Weather conditions, including lack of visibility of the Northern Lights, sea conditions, or other natural factors affecting comfort or visibility.
  • Delays, changes, or cancellations due to force majeure events as described in Section 8.
  • Accidents, damages, or service failures caused by third-party suppliers, provided that Tromsø Explorer has exercised reasonable care in selecting such suppliers.
  • Loss, theft, or damage of personal belongings during tours and activities.
  • Injuries, accidents, or damages resulting from the customer’s own negligence, failure to follow safety instructions, intoxication, or health conditions.

7.4 Insurance

We strongly recommend that all customers hold valid personal travel insurance covering medical expenses, personal belongings, cancellations, and participation in outdoor activities.

8. Force Majeure

Tromsø Explorer is not responsible for delays, cancellations, or changes resulting from events beyond our control. These include, but are not limited to:

  • Natural disasters
  • Government restrictions or regulations
  • Epidemics or pandemics
  • Acts of terrorism
  • Strikes or labor disputes

In such cases, Tromsø Explorer will make reasonable efforts to notify affected customers and will offer suitable alternatives, such as rescheduling the tour or providing a full refund where applicable.

9. Intellectual Property

All content on TromsoExplorer.no, including but not limited to text, graphics, images, logos, and media, is the property of Tromsø Explorer and protected under Norwegian copyright laws. You may not copy, reproduce, distribute, or use any content without our written consent.

10. Privacy

Your personal data is collected, processed, and stored in compliance with the Norwegian Personal Data Act and the EU General Data Protection Regulation (GDPR). Please refer to our full Privacy Policy for details. We also use cookies as described in our Cookie Policy.

11. Governing Law

These Terms are governed by the laws of Norway. Any disputes arising from these Terms or your use of our services shall be settled in the Norwegian court – Nord-Troms og Senja District Court.

12. Consumer Rights

Under Norwegian consumer protection law, you are entitled to:

  • Clear and accurate information about our services, including pricing and inclusions.
  • The right to cancel within specified timeframes as described in Section 4.
  • In case of deficiencies in the delivered services, Tromsø Explorer will offer appropriate remedies in accordance with Norwegian law, including re-performance of the service where possible, a reasonable price reduction, partial refund, or alternative arrangements of equal or greater value.

Nothing in these Terms limits your statutory rights.

13. Claims and Complaints

If you experience a problem during your tour or activity, you must inform Tromsø Explorer immediately so that we have the opportunity to correct the issue where possible.

Any claims or complaints regarding deficiencies must be submitted to Tromsø Explorer in writing (email: info@logins.no) without undue delay and no later than two months after the service was provided. Claims submitted after this deadline may be rejected unless special circumstances apply.

14. Changes to Terms

Tromsø Explorer may update these Terms from time to time. Any changes will be posted on our website with the updated effective date. Continued use of our services after the Terms are updated constitutes acceptance of the new Terms.
